Sale of Real Property

    The sale is subject to confirmation by the sellers who are here today.
    This sale is not subject to confirmation by a court and will not be left open for upset bids. We specifically reserve the right to reject any and all bids.
    The subject properties are being purchased “As Is” and Where Is”
    The improvements located on the property may contain lead based paints, mold, asbestos, termites and/or subsurface oil or gasoline tanks, and the Buyer has been advised of the possible presence of any and all of these matters and if the successful bidder, the Buyer shall purchase the subject real property and improvements understanding the responsibility for the existence and remediation of these matters are being transferred to and will hereafter be the responsibility of the Buyer upon the execution of an Offer to Purchase and Contract. Seller has no knowledge of any existing environmental issues on the property, and Buyer purchases the property as is with the assumption of any responsibility for compliance with environmental regulations

    The property is being offered for sale for cash. The Buyer will be required to deposit $5,000.00 (Five Thousand Dollars) non-refundable funds upon acceptance of the high bid. Ten (10%) Percent of the purchase price is due within 10 Business days of Auction and the balance of the purchase price will be due within 30 days from today. The property is being sold in it’s present condition.

    The seller will be responsible for the payment of the 2010 ad valorem taxes up to the date of closing. The purchaser will assume the balance of the 2010ad valorem taxes due. Chris Burris as Executor for the Estate of Rhonda June Helms Burris are offering to sell and convey all of their right, title and interest in and to this property by a general warranty deed. The property is being sold subject to the conditions, restrictions, reservations and easements of record. The deed will be prepared by the attorney of the Sellers choosing and will be delivered to the Purchaser in exchange for the balance of the purchase price at closing, in the event this sale is approved. The seller will also pay for the necessary excise tax stamps to be affixed on the deed.
